After I got hit by a car while riding my bicycle, I thought I was the unluckiest person in the world. Now that I’m writing this blog and doing research into other personal injury cases, however, I begin to realize how grateful I truly am. Do you know why I feel so grateful? I survived. Thousands of people die every year in car accidents because of someone else’s negligence and I was one of the lucky ones who made it through.
I was just reading from a local lawyer about a deadly car accident case that took place in Fort Worth, Texas and I couldn’t help but get emotional. I felt personally connected to the deceased victim and their family. While the victim wasn’t riding their bicycle when the accident happened, they were completely innocent and unaware of how their life was about to end. Similarly, the family had no idea they were about to lose a loved one because someone else was distracted behind the wheel. It’s so frustrating to feel so helpless.
Seeking Justice for Wrongful Death
I eventually got past my emotions when reading about this case and wanted to hear more about how the family found justice. After an investigation was done into the wreck, it turns out that the driver had been texting behind the wheel. I’m sure the driver felt an immense amount of guilt for killing someone over a simple text message, but this doesn’t excuse the fact that they should have to pay for their negligence.
The family was able to file a lawsuit for wrongful death in order to obtain compensation on behalf of the deceased, but it wasn’t an easy battle. They needed to gather evidence proving that the driver was negligent, which involved obtaining the phone records of the defendant. The defendant refused to turn over these records, but, after months of fighting, the records were finally released. To top it all off, a witness finally came forward to testify against the defendant.
Seeing the Glass Half-Full
The family’s personal injury lawyer was ruthless during their pursuit for a settlement and I know from my own experience that having a strong legal team can be the key to winning a tough case such as this. I know that no amount of compensation will be able to heal this family from what that driver took from them, but hopefully, the money helped in some way.
My settlement money was never able to give me back my athletic ability and I’ll forever feel saddened knowing I’ve lost that, but when I read stories like this, I can’t help but look at the glass half-full and feel blessed. I walked away from my accident not only with my life, but also with the ability to think, walk, and pursue other dreams of mine.
